Saudiathon Terms and Conditions Agreement
GENERAL
- By registering to participate for this Saudiathon, you hereby agree to be bound by these Terms and Conditions (the "Terms"), along with any other Specific rules which relate to the Saudiathon.
- In these Terms and Conditions, "Saudiathon", "Saudia Group", "the Organizer" All considered a reference to Saudi Arabian Airlines Corporation and/or it’s subsidiaries. "You", "Startups" All considered reference to the Participant.
- Saudia Group reserves the right to withdraw or amend any terms and conditions if it considered necessary or appropriate to do so. Any changes will be posted on our website and/or through email. The Participant is responsible for being aware and informed of such changes.
INTELLECTUAL PROPERTY RIGHTS AND DATA PROTECTION
- Each party retains ownership of their own intellectual property rights and property. No party shall infringe upon the intellectual property rights of the other.
- Any ideas, concepts, designs, or inventions created by participants during the Saudiathon that are not registered as intellectual property shall be considered public domain and may be freely used by any party.
- Participants acknowledge that they retain ownership of their submissions, including all associated intellectual property rights, and grant Saudia Group a non-exclusive, royalty-free license to use, reproduce, modify, and distribute their submissions for the purposes of the Saudiathon.
- Participants warrant that their submissions do not infringe upon the intellectual property rights of any third party. Any breach of intellectual property rights shall be the sole responsibility of the participant.
- Participants agree to return all copies of materials, including designs and drawings, to Saudia Group in their original formats, and to destroy any data provided by Saudia Group upon the conclusion of the Saudiathon.
- Participants may not publish any confidential materials or represent Saudia Group without prior written permission.
- Participant does not have the right to publish any of the Saudia Group’s private publications or anything related to the work assigned to them, either during or after the Saudiathon event, without prior written permission from Saudia Group.
- Participant will not represent or speak on behalf of Saudia Group, or anything related to the Saudiathon at official events or on any media platforms without the prior written approval of Saudia Group.
- You agree that the Saudia Group may use your registration (whether or not you were selected for a PoC at the Saudiathon) for any promotional purpose (for example, placing it on the on website or on any poster, leaflet or other advertising media).
- You are aware that Saudia Group, for the purpose of this engagement, may store and process your personal data. Saudia Group is obligated by law to maintain the highest security standards for such data in accordance with the applicable data protection regulations.
- Saudiathon will use personal information that you provided with your registration for the purposes of this engagement and for marketing purposes including the distribution of regular email updates or newsletters. Any personal information relating to Participant will be used solely by Saudia Group in accordance with the applicable data protection regulations.
CONFIDENTIALITY
- All Confidential Information disclosed under this Saudiathon, shall remain the property of Saudia Group. Nothing in this Terms and Conditions is intended to grant any rights to the Participant under any patent, copyright, trade secret, or other Intellectual Property right, except the limited right to use the Confidential information for the purpose of this event. Participant acknowledges that they may not disclose any confidential information to any third party without the prior written approval of Saudia Group. Furthermore, any violation of the terms in this clause may expose Participant to legal accountability in accordance with the laws of the Kingdom of Saudi Arabia.
PARTICIPATION AND ELIGIBILITY
- Saudiathon is open to all individuals affiliated to startups aged 18 and above, subject to the terms and conditions outlined herein. Participation is free of charge, and there is no registration fee. It’s the Participant sole responsibility to register and provide accurate information prior to the event.
- In any event, employees, agencies, contractors, and immediate family members of the Saudia Group are not eligible to participate.
- Saudia Group will verify the eligibility of Participants and disqualify any individual who do not meet the eligibility criteria.
- There is no guarantee or promise that Saudia Group will select any particular idea, concept, or solution submitted by the Participants. The selection of winning entries is at the sole discretion of the Saudiathon judges and organizers.
- Saudia Group reserves the right to use, implement, or further develop any ideas, concepts, or solutions submitted by participants, regardless of whether that submission wins a prize or is officially selected as a winner.
ACCOMMODATION AND TRANSPORTATION FOR NON-LOCAL PARTICIPANTS
For Participants who are traveling from outside the local area where the Saudiathon is being held, Saudia Group will provide the following:
- Tickets and Accommodation: Saudia Group will cover the cost of roundtrip airfare or other transportation to bring non-local participants to the Saudiathon location. Additionally, Saudia Group will arrange and pay for accommodation for the duration of the event.
- Participant Expenses: Saudia Group will not be responsible for covering any other personal expenses incurred by Participants, such as meals, entertainment, or other miscellaneous costs. Participants will be responsible for these additional expenses during their stay.
- If the Participant is disqualified or is not shortlisted for the eligibility of being one of the top positions, Participant will be eligible to stay for the entire event to watch and engage with the event. However, if Participant decided to leave the event, then any cost associated with their travel (flights, accommodation, transportation, etc..) will be their own responsibility and will not be covered by Saudia Group.
- If a Participant wishes to extend their stay beyond the original event dates, they will be responsible for the extended stay beyond the event dates which included, but is not limited to, any accommodation costs, visa, transportation, and any costs related to this extension. Additionally, Participants will be responsible for covering the costs of their travel back home.
PARTICIPANT DISQUALIFICATION
- Saudia Group reserves the right to exclude any participant from Saudiathon at any time, for any reason. Reasons may include, but are not limited to, violation of policies, disruptive, unethical or unsafe behavior, failure to make reasonable progress on a project, or any other conduct deemed unacceptable by Saudia Group. Participants who are excluded will not be eligible for any prizes or awards and must leave the premises immediately if asked by the Organizers. The decision shall be final and not subject to appeal.
LIABILITY AND SAFETY
- Participants agree to follow all rules and instructions from event Organizers and event staff.
- Saudia Group is not responsible for any damages, theft, or loss of personal items brought to the event.
- Saudia Group are not liable for any injuries sustained during your stay for the event or during the event or be liable for any damages, injuries, or losses incurred by Participants during the event.
- In no event shall Saudia Group be responsible for any special, incidental or consequential damage arising out of or in connection with Saudiathon. Special, incidental, or consequential damages include, without limitation, economic loss, loss or damage to any property or person or any other exemplary, punitive or similar damages.
SUBMISSIONS
- Participant agrees to submit all Submissions, regardless of their completeness or functionality, to Saudia Group at the conclusion of the event.
- Participant acknowledges that Saudia Group reserves the right, in its sole discretion, to accept or reject any Submission.
- Submissions will be evaluated by a panel of judges selected by the Saudia Group, and judges will assess the submissions based on criteria such as innovation, technical implementation, user experience, and potential impact. The decisions of the judges are final and binding, and no correspondence will be entered into regarding the judging process or results.
PRIZES AND AWARDS
- Prizes may be awarded to the top participants as evaluated by our panel of independent experts.
- Saudia Group reserves the right to modify the prizes or not award any prizes at its sole discretion.
- Additional prizes and honorable mentions may be awarded at the discretion of the Panel.
GOVERNING LAW AND JURISDICTION
- These Terms and Condition and any dispute or claim arising out of or in connection with it (whether contractual or non-contractual in nature) is governed by, and is to be construed in accordance with the laws of the Kingdom of Saudi Arabia.
- The courts of the Kingdome of Saudi Arabia shall have the exclusive jurisdiction in relation to any claim or dispute which may arise out of or in connection with this Agreement without regard to its conflict of law’s provisions.
ENTIRE AGREEMENT
- These Terms and Conditions together with any relevant rules, represent the entire agreement between you and Saudia Group in relation to the Saudiathon. The invalidity, illegality, or unenforceability of the whole or any part of the Terms and Conditions or any rules does not affect the remainder of these terms and conditions or any rules, which will remain in full force and effect. These terms and conditions and the Specific Rules do not create any right or benefit enforceable by any third party.
BY REGISTERING FOR THIS EXCLUSIVE SAUDIATHON RUN BY SAUDIA GROUP THROUGH F6S PORTAL, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT AND THE TERMS AND CONDITIONS OUTLINED ABOVE
