Terms and Conditions
INTRODUCTION
- The AlFursan Program is owned, operated and monitored by Saudia.
- These terms and conditions govern the manner in which a Member may participate in the AlFursan Program including its services, benefits and rewards offered and as may be changed from time to time (“Terms and Conditions”).
1. DEFINITIONS
- “AlFursan Program” means the AlFursan loyalty program designed to reward Members who have travelled on Qualifying Flights or made Qualifying Purchases.
- “AlFursan Website” means the AlFursan Program website at saudia.com owned and operated by Saudia.
- “Calendar Year” means a calendar year commencing on 1 January and ending on 31 December.
- “Eligible Flights” means the number of flights travelled which: (1) are accumulated by Members after having travelled on Qualifying Flights; and (2) may count towards qualification for upgrading a Membership Tier.
- “Excluded Tickets” means any tickets for flights (whether operated by Saudia, any Skyteam Partner or other aviation carrier Partner) which do not qualify for any accrual of Miles.
- “Family Program” means a feature of the AlFursan Program designed to: (1) encourage a Member aged 18 years or above (the “Head Member”) to link other Members who are part of the Head Member’s family (each a “Family Member”); and (2) combine the Head Member’s and each Family Members’ Reward Miles into a single pool of Reward Miles.
- “Guest Care Center” means the Saudia support center which provides customer care and support services, including related to the AlFursan Program.
- “Member” means an individual registered in the AlFursan Program and who has been given a membership number. “Membership” shall be construed accordingly.
- “Membership Card” means a virtual card issued to Members confirming the Membership number, Member name and Membership Tier.
- “Membership Tier” means each of the following three tiers of membership in the AlFursan Program: Green, Silver (Elite) and Gold (Elite Plus).
- “Miles” means Reward Miles and/or Tier Credits (as applicable).
- “Partners” means entities participating in the AlFursan Program offering products or services to Members as part of their membership benefits.
- “Partner Flight” means any applicable flight operated by any SkyTeam Partners or other aviation carrier Partners (as determined by the relevant SkyTeam Partner or other aviation carrier Partner).
- “Qualifying Flights” means: (1) qualifying Saudia Flights (as determined by Saudia); or (2) qualifying Partner Flights (as determined by the relevant SkyTeam Partner or other Partner), but in any event, excludes any flights in connection with Excluded Tickets).
- “Qualifying Purchases” means qualifying products or services offered by Partners.
- “Reward Miles” means the points which: (1) may be accumulated by Members by: (a) earning after having travelled on Qualifying Flights or making Qualifying Purchases; or (b) purchasing or having them transferred or gifted by another Member; and (2) may be redeemed by Members in exchange for Rewards.
- “Rewards” means Reward Ticket, Reward Upgrade and/or other rewards offered by Saudia or Partners from time to time (as applicable).
- “Reward Ticket” means the redemption of Reward Miles in exchange for a Saudia Flight ticket or a Partner Flight ticket.
- “Reward Upgrade” means the redemption of Reward Miles in exchange for travel in a Saudia Flight of a higher cabin class than the cabin class shown on the Saudia Flight ticket.
- “Saudia Flight” means any applicable flight operated by Saudia (as determined by Saudia).
- “SkyTeam Partner” means any Partner who is then a current member of the SkyTeam Airline Alliance from time to time.
- “Tier Credits” means the points which: (1) are earned by Members after having travelled on Qualifying Flights or otherwise earned through offers or campaigns as may be determined by Saudia from time to time in its sole discretion; and (2) may count towards qualification for upgrading a Membership Tier.
2. MEMBERSHIP
- Membership to the AlFursan Program is available to individuals aged 2 years or above.
- Applications by individuals aged 12 years or above for membership to the AlFursan Program can be made on the AlFursan Website or by contacting the Guest Care Center.
- Membership to the ALFURAN Program for individuals aged between 2 and 11 years must be through the Family Program.
- Once registered, Members will be given a Membership Card that is accessible online.
- An individual may use one Membership Card only, and shall not be permitted to hold more than one Membership. If a Member holds more than one Membership, that Member’s Miles shall be merged to the Membership which was obtained first.
- Member names must be as shown in the Member’s passport. Members may request to change the Membership name by contacting the Guest Care Center, and providing supporting documentation such as a passport.
- Saudia reserves the right to cancel Memberships in its sole discretion, as well as any Miles earned under cancelled Memberships.
- Each Membership Card is issued only to the relevant Member. In case of any misuse of the Membership Card (including any use in a manner contrary to these Terms and Conditions, or any violations or infringements of rights or impersonation), Saudia may in its sole discretion cancel the Membership, including cancellation of all Miles earned under that cancelled Membership.
- Members may request to cancel their Membership by contacting the Guest Care Center. Once a Membership has been cancelled, all services, benefits and rewards, including all Miles, will also be cancelled and will no longer be redeemable. Cancelled Memberships cannot be reinstated.
- Memberships are non-transferable.
3. GENERAL
- Any changes, amendments, cancellation, termination or suspension of the AlFursan Program, including its rules, Terms and Conditions or services, benefits and rewards offered to Members, including the Rewards, shall be at the sole discretion of Saudia during the life of the AlFursan Program.
- These Terms and Conditions shall be governed by the laws applicable in the Kingdom of Saudi Arabia. Except to the extent applicable under the laws of other countries, Saudia shall have no liability in respect of Members’ participation in the AlFursan Program in accordance with the laws of other countries.
- Saudia reserves the right to cancel any Membership or refer matters to law enforcement if Saudia suspects a Member has used the AlFursan Program to commit any fraud or illegal conduct.
- Saudia reserves the right to terminate, suspend or amend the AlFursan Program at any time without prior notice.
- To the extent permitted by law applicable in the Kingdom of Saudi Arabia, in the event Saudia terminates, suspends or amends the AlFursan Program, Saudia shall have the right to cancel any earned Miles, and Saudia shall not have any responsibility or liability for the cancellation of Reward Miles and Tier Credits as a result of terminating, changing or amending the AlFursan Program.
- Saudia shall have no responsibility or liability for any postal delays and damages caused by the postal services of any country.
- Members shall be responsible for payment of all applicable fees, charges, taxes and other expenses related to redeeming Reward Miles for Rewards.
4. MEMBERSHIP TIERS
- There are three Membership Tiers available in the AlFursan Program: Green, Silver (Elite) and Gold (Elite Plus).
- Upon registration in the AlFursan Program, Members are automatically enrolled in the Green Membership Tier and will be given a Membership number.
- Qualification for upgrading to a higher Membership Tier to Silver (Elite) or Gold (Elite Plus) is subject to attaining the required number of Tier Credits or Eligible Flights during any one Calendar Year.
- Maintaining the Silver (Elite) or Gold (Elite Plus) Membership Tiers is subject to attaining the required number of Tier Credits or Eligible Flights during any one Calendar Year. In case of failure to maintain a Membership Tier, the then current Membership Tier will be downgraded to the next lowest Membership Tier effective from 1 January the following Calendar Year.
- The validity period of the Green Membership Tier is for the life of the Membership.
- The validity period of the Silver (Elite) or Gold (Elite Plus) Membership Tiers are until 31 December of the following Calendar Year.
- Saudia reserves the right in its own discretion to change the rules governing Membership Tiers, including these Terms and Conditions without prior notice.
- Tier Credits and Reward Miles will be earned based on the Membership Tier then in effect as at the flight departure time.
- Membership Tier upgrades will take up to 48 hours to be reflected in the system.
5. FAMILY PROGRAM
- Family members’ Reward Miles will be accumulated in the main membership account only.
- Managing the Family Program is the responsibility of the main membership holder only.
- Family members may leave or be removed from the Family Program by the main membership holder after completing the permitted period of 6 months.
- Children aged 2 to 11 years old cannot be removed from the Family Program unless they are transferred to another Family Program with a person that has a main membership.
- New members added to the family program will be restricted from redeeming Reward Miles until authorization is granted by the main membership of the family program.
- Reward Miles specific to each membership will be erased from the Family Program pooled account upon departure/removal of the membership holder.
- The invitation to join the Family Program remains valid for 7 days for approval or rejection. After the end of this period, the invitation will disappear from the invitee’s profile on the AlFursan page, and the status of the invitation can be tracked through the Family Program page.
- Any membership that violates the terms and conditions of the AlFursan Program will be banned and all Miles and permissions will be forfeited.
- The mechanism for redeeming Reward Miles in the family account depends on the date on which the Miles were earned for each acquisition, starting from oldest to newest.
6. UPON THE DEATH OF A MEMBER
- The Reward Miles of the deceased Member only shall be transferred to the Membership of the legal heir upon provision of appropriate documentation, such as a death certificate and a legal proxy. The legal heir, his representative or the guardian shall take full responsibility in case of any objection by other Family Members. Saudia shall have no responsibility or liability whatsoever.
- Deceased Family Members aged 18 years or above shall be de-linked from the Family Program.
- Following the death of a Head Member or spouse, Family Members aged under 18 years shall be linked to the Membership of the surviving parent or guardian Member.
- The Membership of a deceased Member will be closed.
- If the required documentation is not provided within twelve (12) months of the Member's death, all Members in the Family Program shall be de-linked without any transfer of Miles.
7. PRIVACY
- Members acknowledge and agree that Saudia shall process Member’s personal information, including for promotional and marketing purposes, in accordance with its Privacy Policy. The information about such use of the Member’s personal information under this section 7 should be read alongside the Privacy Policy available here, which contains detailed information on how a Member’s personal information is processed. Members are encouraged to read and download the Privacy Policy for future reference.
- If a Member does not provide all or any part of the requested information, this may affect the services that Saudia will be able to provide to that Member, and the benefits that the Member receives.
- Saudia collects personal information about each Member as part of the AlFursan Program:
a. to enable Saudia to market products and services to Members, including the products and services of Saudia’s partners and other third parties who Saudia believes may have products and services in which Members would be interested;
b. to facilitate Members’ participation in the AlFursan Program and other organisation’s loyalty programs, including:
(i) by assessing Members’ membership application;
(ii) awarding Members with Miles; and
(iii) confirming Member’s eligibility for, and providing any products and services associated with, the AlFursan Program;
c. for Saudia and third parties to generate customer insights about Members in order to better understand Members’ preferences and interests, tailor Members’ experience, enhance the products and services supplied to Members and to tell Members about the products and services of Saudia and its partners. In order to do this, Saudia may collect and combine personal information about Members from third parties or public sources (e.g. the partners);
d. to identify suspicious transactions and to detect and prevent fraud;
e. to improve Saudia and its websites and services, as well as the AlFursan Program, including by means of product development and market and behavioural research; and
f. for operational management of the AlFursan Program. - Saudia may collect Members’ personal information from Members directly, including during Members’ interaction with Saudia group websites, services or applications or when Members are logged into their Membership accounts. Saudia may also collect Members’ personal information from third parties, Saudia’S group companies, Saudia’s partners, third parties providing services for Saudia and other parties whose services and products may be of interest to Members.
- For the purposes specified above, Members acknowledge and agree that Saudia may disclose Members’ personal
information to:
a. the AlFursan Program partners;
b. its group companies;
c. any third party providing services for the AlFursan Program, including assisting Saudia in determining Members’ eligibility for, and providing, the AlFursan Program products and services (including products and services available to members), administering the AlFursan Program, operating Saudia’s call and service centres, providing market research and marketing services, and assisting with the prevention and detection of fraud; and
d. other third parties, such as law enforcement agencies and courts, in order to comply with its legal obligations or in connection with a legal claim or in response to a validly served and executed court order. - The parties specified above may be located in a country other than the country in which a Member is based, including Germany, the United Kingdom, the United States and the United Arab Emirates and any country which Members travel to or through in connection with their Membership.
- Consent to marketing: By becoming a Member, Member provide their consent to Saudia by:
a. sending Members marketing communications via direct mail, telephone, email, SMS, in-app notifications and advertising or other digital means, including:
(i) news and offers for Members of the AlFursan Program;
(ii) offers, news and updates from Saudia and its partners;
(iii) flight specials, travel deals, news and updates;
(iv) entertainment offers and competitions; and
(v) Saudia branded products; and
b. associating and combining data collected from third parties with Member’s personal information and using and disclosing that combined information to create segments for the purposes of customer analytics and marketing and to tailor Members’ experience and content, including third party content and otherwise in accordance with these Terms and Conditions and the Privacy Policy. - Opt-out of marketing: Members can opt-out of receiving all or any of the marketing communications listed above at any time by visiting the My Profile section of the Member’s account and updating their communication preferences. Opting out of these communications may impact Saudia’s ability to provide Members with all the benefits that would otherwise be available as part of the Membership. Please note that if you tell us that you do not wish to be sent further marketing communications, you will still receive service communications which are necessary; for example, information relating to your Membership, information about bookings you made, products and services you have purchased, and to manage your Membership account.
- Providing third party information to Saudia: Where you provide information relating to third parties to Saudia (for example, information about a Family Member), you confirm that you have obtained any necessary permissions from such persons to the reasonable use and disclosure of their personal information to Saudia and you have provided such persons with Saudia’s Privacy Policy.
8. MILES
- Saver brand is not eligible for upgrade by Miles.
- Tier Credits are applicable for upgrading a Membership Tier. Tier Credits are earned by Members after having travelled on Qualifying Flights during any one Calendar Year.
- Reward Miles are applicable for redemption for Rewards. Reward Miles are earned by Members after having travelled on Qualifying Flights or made Qualifying Purchases.
- Members on Silver (Elite) or Gold (Elite Plus) Membership Tiers will have opportunities to earn additional Reward Miles based on the base miles of Qualifying Flights or travel class categories.
- Reward Miles shall be valid for a 2 year period from the date of the last qualifying activity. To see the current list of qualifying activity, please click here.
- To ensure that Tier Credits are accrued to the Membership, Members must ensure that the Membership number is quoted at the time of reservation or check‑in for Qualifying Flights.
- To ensure that Reward Miles are accrued to the Membership, Members must ensure that the Membership number is quoted: (1) at the time of reservation or check‑in for Qualifying Flights; or (2) at the time of paying for Qualifying Purchases.
- Reward Miles and Tier Credits accrue once per Qualifying Flight per Member based on the fare of the cabin class of the Qualifying Flight that was purchased regardless of the cabin class in which the Member flew.
- Members shall not earn Reward Miles or Tier Credits (Miles/Flight) through: (1) redeemed Reward Tickets; (2)Ticket in saver brand (3)free travel and non-scheduled or charter flight; or (4) non-public specially discounted travel tickets; (5) prize and promotional tickets; (6) industry and agent discounted tickets; (7) tickets without fares or class; (8) compensation tickets; (9) sponsorship or public relations tickets; or (10) group tickets. Any exceptions will be in Saudia sole discretion.
- Reward Miles are not redeemable for cash.
- Saudia reserves the right to deduct any ineligible Reward Miles or Tier Credits from any Membership if Saudia subsequently discovered that they were credited by mistake or as a result of any violation of these Terms and Conditions.
- Where Members are also members of other loyalty programs, Members may not claim services, benefits or rewards for the same transaction from multiple programs. Members must elect the preferred program in which they wish to earn the miles.
- Members between the age of 2 and 11 years will earn Miles at 75% of the rate applicable for Members aged 12 years or over.
9. PARTNERS
- Reward Miles earned from Qualifying Purchases may take up to 60 days to be reflected in the Membership.
- All products and services offered or sold by Partners, including Qualifying Purchases, shall be subject to the terms and conditions of the relevant Partner.
- Saudia is neither responsible nor liable for: (1) any products or services offered or sold by Partners, including Qualifying Purchases; (2) the withdrawal of any of Partners from the AlFursan Program for any reason; or (3) the fulfilment or non-fulfilment of any offers, promises, transactions or obligations of Partners.
- Any rights that a Member may have in connection with products and services offered or sold by Partners, including Qualifying Purchases, are solely against the relevant Partner supplying the relevant product or service.
- Saudia is neither responsible nor liable for any Partners’ crediting or non-crediting of Reward Miles or Tier Credits to a Membership. It is the Member’s responsibility to ensure that Partners have correctly credited the Reward Miles based on the Qualifying Purchases. Accordingly, Members will have no claim whatsoever against Saudia for any such Reward Miles.
- Only Saudia Flights or Partner Flights shall be considered a Qualifying Flight. Accordingly, Reward Miles or Tier Credits can only be earned from Saudia Flights or Partner Flights.
10. MISSING MILES CLAIMS
- Missing Reward Miles or Tier Credits from Saudia Flights may, within a period no later than 360 days after the travel date, be claimed on the AlFursan Website or by submitting an application to the Guest Care Center and providing supporting documents (for example the ticket number in the booking reference and the boarding pass) proving the flight.
- Missing Reward Miles or Tier Credits from Partner Flights may, within the time limits as may be determined by Partners from time to time, be claimed on the AlFursan Website or by submitting an application to the Guest Care Center and providing supporting documents (for example the ticket number in the booking reference and the boarding pass) proving the flight.
- Missing Reward Miles from Qualifying Purchases may, within the time limits as may be determined by Partners from time to time, be claimed on the AlFursan Website or by contacting the Guest Care Center and providing the original documents (such as an invoice or contract).
11. REQUEST TO CLAIM PRE-ENROLMENT MILES
Members may make a request to claim Reward Miles or Tier Credits for Saudia Flights flown 180 days prior to the Membership joining date, provided that the Member has not previously made a claim from a SkyTeam Partner’s or other aviation carrier Partner’s loyalty program for the same flight. This request may be made by submitting an application to the Guest Care Center and providing supporting documents (for example the ticket number in the booking reference and the boarding pass) proving the flight. Any approval of such request shall be in Saudia’s sole discretion.
12. REWARDS
- Reward Miles may be redeemed for Rewards only by the Member (or by a Head Member on behalf of a Member aged between 2 and 11 years).
- To claim a Reward, a Member must have accumulated the required amount of Reward Miles in his or her Membership. Members may redeem Reward Miles for Rewards at any time while the Reward Miles are valid, subject to availability and applicable conditions as set out in these Terms and Conditions or in terms and conditions imposed by Partners. Saudia may at any time without notice alter the number of Reward Miles required to obtain a particular Reward, withdraw a Reward supplied or impose additional restrictions on a Reward or conditions of obtaining it.
- All Rewards are subject to availability and suppliers' restrictions. Rewards may not be available on all flights at all times. Saudia may withdraw, replace or substitute Rewards at any time without notice.
13. REWARD TICKETS
- Members must have sufficient Reward Miles available in the Membership to qualify for Reward Tickets redemption.
- Reward Tickets are issued based on a confirmed booking only.
- Reward Ticket reservations are subject to ticket time limits.
- Tier Credits or Reward Miles cannot be earned against Reward Tickets.
- Reward Tickets are valid for one year from the original date of issuance.
- Reward Tickets can be re-issued according to the policies.
- Rewards Tickets are refundable or can be rebooked (subject to refund terms and conditions).
- Reward Tickets are subject to taxes, service charges, government-imposed fees and carrier-imposed charges, each of which shall be payable by the Member.
- Members may redeem a Reward Ticket for themselves or for any third party.
- Reward Tickets are governed by and subject to the Saudia Conditions of Carriage applicable to Reward Tickets and the Programme Rules at the time of booking.
- Reward Tickets can be refunded online or by contacting the Guest Care Centre.
- Refund fees or rebooking fees will apply and can be paid by credit card through the Guest Care Centre or cash through Saudia sales offices.
- Unutilized sectors of partially utilized Reward Tickets are eligible for refund.
- Any expired Miles that are refunded to the Membership will automatically be removed from the account.
- Expired Reward Tickets are not eligible for a refund (validity of Reward Tickets is one calendar year from the date of issue).
14. REWARD UPGRADES
- Reward Upgrades are available only on Saudia Flights (excluding Saudia codeshare flights operated by another carrier) and may be redeemed on a sector basis.
- Members must have sufficient Reward Miles for the requested Reward Upgrade at the time they request a Reward Upgrade.
- Only a single cabin upgrade is permissible e.g. Guest Class to Business Class, or Business Class to First Class.
- After the conclusion of Reward Upgrade, no further Reward Upgrades will be permitted for any of the remaining sectors.
- Members must hold a confirmed ticket for the flight they wish to upgrade prior to requesting a Reward Upgrade.
- Reward Upgrades are subject to specific booking class availability.
- All taxes (including airport and/or government taxes), fees and carrier-imposed charges where applicable are the responsibility of Members and must be paid prior to the issuance of the Reward Upgrade.
- Members can upgrade the remaining itineraries in the base ticket if it is partially utilised.
- Reward Upgrades using Miles are refundable and can be rebooked.
- Miles earned for a Reward Upgrade will be according to the booking class of original ticket before being upgraded.
- Reward Upgrades are not permitted on Guest Saver (U Class), Special Fare, free and discounted tickets.
- All tickets, including base and upgraded tickets are subject to, and governed by, their applicable rules, terms and conditions in effect and as amended from time to time.
15. BUY, GIFT OR TRANSFER REWARD MILES
- Members may purchase, transfer or gift Reward Miles through the Saudia Website and Mobile App.
- Members may purchase Reward Miles for his or her own Membership or purchase and gift another Membership for a minimum of 1,000 Reward Miles and up to a maximum of 80,000 Reward Miles in a month.
- Members may transfer Reward Miles to another Member for a minimum of 1,000 Reward Miles and up to a maximum of 40,000 Reward Miles in a month.
- Refund of purchases, transfers or gifting of Reward Miles is not permitted after the completion of the transaction.
- Saudia reserves the right to change the fares for purchase, transfer or gifting of Reward Miles or to impose additional restrictions on earning Reward Miles at any time without any prior notice.
- Member may not sell Reward Miles, directly or indirectly, for cash or any other consideration. Members may not purchase Reward Miles from any person.
- Any misuse or improper conduct involving the purchase, transfer or gifting of Reward Miles, or otherwise contrary to these Terms and Conditions shall be grounds for immediate cancellation of such Reward Miles, as well as cancellation of all other Reward Miles in the Membership account. Saudia reserves the right to cancel the Membership.
- Saudia shall be authorized to charge the credit card that Members provide for the transaction amount stated, which shall be based on the number of Reward Miles purchased by the Member at the prevailing rate. In the event of any Reward Miles or other financial discrepancy, the payment calculations under these Terms and Conditions shall be based upon data contained in Saudia’s records, and the data in Saudia’s records shall take precedence over the data in any other records.
16. Cash + Miles
- The service is considered as a new form of payment on SV prime flights (excluding Codeshare flights) to be used only on any 1st issuance of any tickets and/or some selected ancillaries by combining a minimum balance of miles with other forms of payment such as cash or acceptable credit cards.
- The miles can be exchanged against the fares not including taxes and fees.
- The minimum miles required are 2000 miles for tickets; and 500 miles for ancillary.
- Individual members can take advantage of the Branded Fares process to purchase tickets and services, which include the same benefits and some restrictions, such as accumulating miles, upgrading eligibility, changes, and cancellations.
- Upon any changes (through digital channels, the difference will be collected using credit cards if the change is to a higher fare, while changes to a lower fare will automatically be refunded the remaining miles after deducting any fees.
- Prior to processing the request at Saudia's Call Centres and Sales Offices, fees may be collected separately.
- In case of circumstances beyond Saudia’s control or any unforeseen flight disruptions, Saudia will take all necessary measures to accommodate all guest requests. Nevertheless, requests for involuntary changes or refunds will be allowed in case of flight delays or cancellations according to Saudia's policies.
- Involuntary refunds will be made in the same currency and payment method as at purchase.
17.AlFursan Store
1. Introduction
The AlFursan Store located at [Terms and Conditions - AlFursan] (“AlFursan Store”), is owned by Saudi Arabian Airlines Corporation, a public and independent organization established by Royal Decree No. M/24 of 18.07.1385H (11.11.1965G) and having its registered address at P.O. Box 620, Postal Code 21231, Kingdom of Saudi Arabia (“We”, “Us”, “Our” or “SAUDIA”).
These AlFursan Terms of Use must be read in conjunction with, and are subject to, the AlFursan Program Terms and Conditions located at [Terms and Conditions - AlFursan] (together the “Terms of Use”). To the extent of any inconsistency between the AlFursan Program Terms and Conditions and these AlFursan Terms of Use, then the AlFursan Program Terms and Conditions shall prevail. These Terms of Use govern your access to and use of the AlFursan Store, including but not limited to any transactions where you use a Payment Method to purchase Products (each, a "Transaction"). We have authorized MYLIST SAUDI ARABIA FOR TRADING SERVICES LLC, trading as “Merit” with unified ID number 7008312600, having its registered address at c/o Prince Saud Ibn Abdullah Ibn Jalawi Road, Al Qairawan, Building 2359, P.O. Box 13531, Riyadh, Kingdom of Saudi Arabia (“MERIT”) to fulfil any Transaction. Any reference to the “fulfilment” of a Transaction throughout these Terms of Use entails that MERIT is the principal seller of the Products while SAUDIA is the provider of the AlFursan Store simply as a marketplace whereby SAUDIA’s role is limited to facilitating the Transaction between customers and MERIT. As such, all terms of sale and obligations relating to Us throughout these Terms of Use refer to the terms of sale of the actual seller of the Products.
By accessing or using the AlFursan Store, or upon the conclusion of any Transaction, you are deemed to have indicated your agreement to be bound by these Terms of Use. If you do not agree with these Terms of Use, you must immediately cease accessing or using the AlFursan Store and you will not be permitted to conclude any Transaction.
We reserve the right, at our sole discretion, to update these Terms of Use from time to time by publishing an appropriate notice, of at least 1 week, and the updated Terms of Use on the AlFursan Store. By accessing or using the AlFursan Store, or upon conclusion of any Transaction, you are deemed to have indicated your agreement to be bound by the updated Terms of Use. If you do not agree with the updated Terms of Use, you must immediately cease accessing or using the AlFursan Store, and you will not be permitted to conclude any Transaction.
In these Terms of Use, the following definitions apply unless otherwise stated:
“AlFursan Account” means your AlFursan Program account that you log into in order to access and use the AlFursan Store.
“AlFursan Program” has the meaning given in the AlFursan Program Terms and Conditions.
“AlFursan Program Terms and Conditions” means the terms and conditions located at [Terms and Conditions - AlFursan] which govern the manner in which a Member may participate in the AlFursan Program including its services, benefits and rewards offered and as may be changed from to time.
“AlFursan Store” has the meaning given in the Introduction.
“Business Days” means the working days in the Kingdom of Saudi Arabia except for Friday and Saturday and any public holiday announced by the government of the Kingdom of Saudi Arabia.
“Claims” has the meaning given in clause 11(d).
“Contact Form” has the meaning given in clause 7.2(a).
"Intellectual Property Rights" has the meaning given in clause 9(b)(xii).
“Member” or “Membership” has the meaning given in the AlFursan Program Terms and Conditions.
“Payment Method” has the meaning given in clause 5(c).
“Privacy Policy” means SAUDIA’s Privacy Policy located at https://www.saudia.com/help/useful-links/legal-and-terms-and-conditions/privacy-policy.
“Products” shall mean any products as may be made available for purchase in the AlFursan Store from time to time, including but not limited to gift cards (physical and electronic), merchandise items, mobile top ups and experience vouchers.
“Product Terms and Conditions" means the third-party terms and conditions (including any warranty information) applicable to each individual item of Product, as may be communicated to you at the time of purchasing the Product.
“Reward Miles” has the meaning given in the AlFursan Program Terms and Conditions.
“Supplier” shall mean the third-party entities we are contracting with in order to fulfil your orders and provide you with the Products you purchase from the AlFursan Store.
“Transaction” has the meaning given in the Introduction.
2. Eligibility
(a) To access or use the AlFursan Store, including purchasing Products, you must:
(i) be a Member of the AlFursan Program;
(ii) have an active and valid AlFursan Account;
(iii) have the legal capacity to enter into legally binding contracts in accordance with the laws of the Kingdom of Saudi Arabia; and
(iv) comply with these Terms of Use.
(b) The AlFursan Store is not intended for use by individuals or entities in prohibited jurisdictions, or by individuals or entities prohibited by our policies in force from time to time.
3. Accessing the AlFursan Store and Privacy
(a) You can access and use the AlFursan Store by logging in through your AlFursan Account.
(b) You are responsible for maintaining the confidentiality of your AlFursan Account login credentials, including your username and password.
(c) You agree to immediately notify us of any unauthorized use of your AlFursan Account or any other breach of security.
(d) We are not liable for any loss or damage resulting from your failure to protect your Account credentials.
(e) We are committed to protecting the privacy of your personal data. We collect, process, protect and retain your personal and financial data in accordance with our Privacy Policy.
(f) We recommend that you review our Privacy Policy.
4. Redemption of Reward Miles
(a) The AlFursan Store allows you to purchase Products by:
(i) redeeming your Reward Miles (if you have sufficient balance);
(ii) redeeming your Reward Miles (if you have sufficient balance) plus an additional payment; or
(iii) payment of the specified price,
in each case, subject to the AlFursan Program Terms and Conditions, these Terms of Use and each of the applicable Product Terms and Conditions.
(b) The minimum redemption threshold is 2,000 Reward Miles per product.
(c) We reserve the right at any time to set or change the prices of Products and/or Reward Miles redemption values (or any combination thereof).
5. Transactions
(a) All Transactions in the AlFursan Store are final, non-refundable and non-cancellable unless stated otherwise herein.
(b) You agree to bear, and pay for, all applicable taxes, duties, payment gateway fees, delivery fees, and other fees and charges associated with all Transactions in the AlFursan Store (as specified during the purchase process).
(c) We accept payment by:
(i) credit/debit card;
(ii) MADA, MADA Pay or Apple Pay;
(iii) redemption of your Reward Miles redemption (if you have sufficient balance); or
(iv) redemption of your Reward Miles (if you have sufficient balance) plus credit/debit card,
(each, a “Payment Method”).
(d) Please note that not all of the aforementioned Payment Methods may be applicable to certain or all Products shown in the AlFursan Store, and accordingly you are requested to adhere to the Payment Methods displayed and made available at the time of purchasing the Product.
(e) We may, at any time and without prior notice to you, remove any of the Payment Methods or add other payment methods.
(f) You authorize us, our Suppliers and/or our third-party payment processors to process your payment through the applicable Payment Method for the value of your purchase and to use your financial and personal data in order to fulfil your Transaction.
(g) In order to authorize payments other than redemption of your Reward Miles, you may be required to provide certain information such as your billing and address information for our third-party payment processors, including accepting their standard terms and conditions.
(h) You are ineligible to accrue Rewards Miles when purchasing Products from the AlFursan store.
6. Purchasing Products
6.1 Purchase Process
(a) To purchase Products from the AlFursan Store, you must follow these steps:
(i) select a Product from the AlFursan Store catalogue;
(ii) complete the payment process using one of the available Payment Methods (once your purchase is received by us and/or our Suppliers, we will process it); and
(iii) Products will be delivered to you either via email or to the physical address you provided at the time of placing your purchase (depending on the type of Product purchased).
(b) You acknowledge that some purchases may not be processed due to potential or actual suspicious or fraudulent activities.
6.2 Physical Products
(a) Delays: You acknowledge that the Suppliers providing us with Products may occasionally experience delays. These delays may impact our ability to deliver the Products within the specified timeframe. In such cases, we will notify you via the email address you registered with us and we will provide an updated delivery timeline or offer an alternative solution.
(b) Non-Cancelable, Non-Transferable and Non-Refundable: You acknowledge that, unless you notify us of an error within twenty-four (24) hours in accordance with clause 6.6(a), you notify us that you wish to rescind the Transaction in accordance with clause 6.7, or you notify us that you have changed your mind in accordance with clause 6.8, physical Products cannot be canceled, transferred, exchanged or refunded if you have used, redeemed or benefited from any Products purchased.
6.3 Digital Products
(a) Delivery Timeframe: Except in cases of fraud, digital Products, (including e-gift cards and offers) will be fulfilled within twenty-four (24) hours of completing the Transaction.
(b) Non-Cancelable, Non-Transferable and Non-Refundable: You acknowledge that, unless you notify us of an error within twenty-four (24) hours in accordance with clause 6.6(a), you notify us that you wish to rescind the Transaction in accordance with clause 6.7, or you notify us that you have changed your mind in accordance with clause 6.8, digital Products cannot be canceled, transferred, exchanged or refunded if you have used redeemed or benefited from the digital Product purchased.
(c) Expiration Date: Some digital Products like gift cards and vouchers will have an expiry date clearly outlined in their Product Terms and Conditions. The minimum validity for gift cards and vouchers is six (6) months from the activation date unless we notify you otherwise. Please make sure you check the validity of the Products as stipulated in the Product Terms and Conditions, as we will not be held responsible for notifying you regarding the expiry of the Product.
6.4 Physical Products Delivery
(a) Delivery Timeframe: We will aim to deliver physical Products within three (3) to seven (7) Business Days for domestic deliveries (within the Kingdom of Saudi Arabia) and seven (7) to fourteen (14) Business Days for global deliveries.
(b) Delivery Address: Products will be delivered to the address specified by you when purchasing the Product. If a rescheduled delivery is required, you will be responsible for any associated re-delivery costs.
(c) Out of Stock or Unavailable Products: If a Product you purchased is unavailable or cannot be fulfilled for any reason, we will aim to notify you by email within twenty-four (24) hours, provide the expected availability date or suggest an alternative Product of similar category, price, and quality. If you accept the suggested replacement, we will aim to ship it within five (5) Business days.
(d) Damaged or Unusable Products: If you receive a Product that is damaged or unusable, please contact our customer care team via the Contact Form (detailed in clause 7 below), and we will aim to arrange a replacement within seven (7) Business Days from the date we receive your notice.
(e) Gift Card Address Change: For physical gift card deliveries, if you request a change of delivery address after shipment, we will attempt to obtain your new address within two (2) Business Days.
(f) Purchase Cancellation: We will aim to process purchase cancellation requests within three (3) Business Days (if applicable).
6.5 Purchase Refunds Timeframes
(a) Unavailability or Defective Products: If your purchase cannot be fulfilled due to Product unavailability or if the Product is defective and you do not accept the proposed alternative or replacement, we will aim to process the refund of the purchase value within fifteen (15) Business Days. If your purchase was paid by redeeming Reward Miles, we will aim to process the refund within one (1) Business Day from the date you notify us that you do not accept the proposed alternative Product.
(b) Credit Card/Debit Card Payments: If your purchase was paid by credit card or debit card (including payments via Apple Pay), we will aim to process the refund through the payment gateway within one (1) Business Day. You will receive the refunded amount according to your bank's processing timeframes.
(c) MADA/MADA Pay payments: If your purchase was paid using MADA or MADA Pay we will aim to process the refund within three (3) Business Days, and you will receive the refunded amount according to your bank’s processing timeframes.
6.6 Notification of errors
(a) You may notify us of any error that you wish to rectify within twenty-four (24) hours of initially communicating with us. We will aim to rectify your error unless you have used, redeemed or benefited from any Products (including digital Products) purchased.
(b) We may correct any unintended errors when communicating with you (including processing your Transactions) as soon as we become aware of the error before delivery of your Products. You have the option to accept our rectification or request a refund of the Products purchased.
6.7 Rescinding a Transaction
Except for errors notified to us within twenty four (24) hours in accordance with clause 6.6(a) or Products described in clause 8.5, you have the right to rescind your Transaction within seven (7) days following the date of receipt of the Product provided that you have not used, redeemed or otherwise benefited from the Product (including digital Products), in which case you agree to bear the costs of rescinding the contract.
6.8 Change of Mind While Order Status Is “Placed”
You may notify us to request a refund or exchange if you change your mind while your order status remains in the status of Placed. However, once your order status changes to In Progress, Shipped, or Delivered, you will no longer be eligible to request a refund or exchange, unless clause 6.6 or clause 6.7 applies.
You will receive notifications for orders that are in the status of Placed, and you may track your order status at any time through the My Orders section in the AlFursan Store.
7. Customer Care
7.1 Support Channels
To ensure efficient handling of your inquiries and issues, we provide the following support channels:
(a) Contact Form: You are required to submit all inquiries and issues through the online Contact Form or the chat-based support system. These tools offer access to a self-service knowledge base, enabling you to troubleshoot and find answers to common questions independently.
(b) Chatbot: The Chatbot is an automated self-service support tool designed to help you with basic or simple inquiries, including Frequently Asked Questions (FAQs). The Chatbot will provide responses to your inquiries.
(c) Contact Form for Specific Inquiries: If your inquiry cannot be resolved through the Chatbot, the Contact Form allows you to submit more detailed inquiries. This includes cancellation requests (when applicable) and/or any other concerns related to your purchases, Products or the AlFursan Store.
7.2 Contact Form Details
(a) The Contact Form is a digital form that you are required to fill out if the Chatbot is unable to resolve your inquiry (the “Contact Form”).
(b) Upon receiving your inquiry through the Contact Form, we will respond to your submission and contact you either via email or by phone (if necessary).
(c) In some cases, we may call you to gather additional information or provide updates on the resolution of your inquiry.
7.3 Personal Data Retention and Processing
(a) We will retain and process the personal data you provide in your inquiry in accordance with our Privacy Policy.
(b) This information will be used to review and resolve your inquiry efficiently.
7.4 Resolution Process
(a) After reviewing your inquiry, we will send you a written resolution via email.
(b) Once you accept the proposed resolution in writing, we will proceed with implementing it. Please note that once you have accepted the resolution, you cannot withdraw your decision.
(c) We will keep you updated on the status of your inquiry and the progress of the resolution.
7.5 Customer Care Timeframes
We are committed to responding to your inquiries promptly. Our response times are as follows:
(a) Acknowledgment of Receipt: We will aim to acknowledge receipt of your inquiry within one (1) Business Day from the date we receive it.
(b) Resolution of Inquiry: We will aim to resolve your inquiry within three (3) Business Days. In some cases, this timeframe may be extended depending on the complexity of the issue.
8. Products Return Process (Applicable to Physical Products)
We understand that occasional returns may be necessary. The following return conditions outline our return and exchange policy for physical Products:
8.1 Faulty, Damaged, or Defective Products: You may return a Product if it is found to be faulty, damaged, or defective upon receipt.
8.2 Return, Exchange, or Refund Requests: You may also return or exchange the Product or request a refund if it meets the applicable return conditions outlined herein.
8.3 Notification of Defects: If you receive a Product that is defective or damaged, you must notify us of the issue within three (3) Business Days from the date of delivery. Failure to notify within this period may result in your return request being denied.
8.4 Acceptance of Product Delivery: By accepting the delivery of the Product, you acknowledge that, unless the Product is damaged, you assume all risks associated with the Product. In the event a fault develops after delivery, you will need to contact the manufacturer directly, following the manufacturer’s warranty terms and conditions.
8.5 Non-Refundable or Non-Returnable Products: Certain Products are non-refundable and cannot be replaced, exchanged or returned. These include:
(a) customized or made-to-order items;
(b) perishable goods (e.g., food items);
(c) personal items (e.g., hygiene items);
(d) computer software, videotapes, records, compact discs or records that have been used;
(e) newspapers, magazines, books or other publications;
(f) accommodation, transportation or catering services;
(g) defects attributed to your mishandling;
(h) online downloadable software; and
(i) any other Products explicitly stated according to applicable laws.
8.6 Consumer Protection Law: You are entitled to all your rights in accordance with the applicable consumer protection law in the Kingdom of Saudi Arabia.
9. Your Obligations
(a) When using or accessing the AlFursan Store, including when purchasing Products and concluding Transactions, you agree that you:
(i) are responsible for maintaining the confidentiality of, and restricting access to and use of your Account and password, and accept responsibility for all activities that occur under your Account;
(ii) agree to immediately notify us as prescribed in clause 3 of any unauthorized use of your Account or any other breach of security;
(iii) will provide true, accurate, current and complete information about yourself and your use of the AlFursan Store as required by us;
(iv) will not disclose to any third-party (except as required or requested by us) a user’s information provided to you; and
(v) will cooperate with our requests for additional information with respect to your eligibility and usage of our Services and AlFursan Store;
(vi) will comply with the following:
A. Unauthorized Resale: You agree that gift cards and the other Products shall not be resold, exchanged, or transferred in exchange of cryptocurrencies or other form of digital assets that is not considered to be legal tender;
B. Redemption for Cash: Gift cards and Products shall not be redeemed for cash, either partially or fully, except as required by applicable law. Any attempt to convert gift cards to cash through unauthorized means is strictly prohibited;
C. Use for Illegal Activities: You will not use or allow the use of gift cards or any Product for any purpose that is illegal, fraudulent, or in violation of any applicable laws or regulations. This includes, but is not limited to, money laundering, financing of terrorism, or other criminal activities;
D. Fraudulent Transactions: You agree to implement appropriate measures to prevent the use of gift cards and other Products in fraudulent transactions. Any misuse, including the use of stolen or counterfeit gift cards, shall be reported to us immediately in accordance with clause 3, and you will cooperate fully in any subsequent investigation;
E. Compliance with Terms and Conditions: You shall ensure that you are aware of the Product Terms and Conditions applicable to such Products and comply with them. This includes any restrictions on the use, expiration, and redemption of any Product;
F. Consequences of Breach: In the event that you violate any of the above prohibited uses, we reserve the right to take corrective action, including but not limited to the suspension or cancellation of your AlFursan Account and purchases, withholding payments, and terminating your access and use of the AlFursan Store;
G. Notification and Cooperation: You shall promptly notify us of any known or suspected prohibited uses of the Products or the AlFursan Store. You agree to cooperate fully with us in investigating and resolving any such issues;
H. Use as Payment for Unauthorized Goods or Services: Gift cards shall not be used as payment for goods or services provided by entities or individuals that are not authorized by us. Any attempt to use gift cards for non-authorized transactions is prohibited;
I. Ineligible Goods and Services: Gift cards shall not be used to purchase certain ineligible goods and services, such as other gift cards or collectible items. The list of ineligible items may be subject to change at our sole discretion; and
J. Transfer After Redemption: Once a gift card's claim code or any other Product has been redeemed, it cannot be transferred to another account. Redeeming a gift card or any other Product intended for another recipient or account is strictly prohibited.
(b) When using or accessing AlFursan Store, including when purchasing Products and concluding Transactions, you agree that you will not:
(i) breach or circumvent any applicable laws, third party rights or our systems, policies or determinations of your AlFursan Account status;
(ii) access or use the AlFursan Store if you no longer fulfill the eligibility criteria referred to in clause 2, or are temporarily or indefinitely suspended from access or using the AlFursan Store;
(iii) fail to pay any amount agreed upon in accordance with these Terms of Use;
(iv) use any stolen debit or credit cards to pay for the Products you purchase;
(v) manipulate the price of any Product;
(vi) interfere with any other accounts on the AlFursan Store;
(vii) take any action that may undermine the AlFursan Store’s feedback and rating systems;
(viii) post false, inaccurate, misleading, deceptive, defamatory or similar content in the AlFursan Store;
(ix) transfer your AlFursan Account to another party without our prior written consent;
(x) distribute or post spam, unsolicited or bulk electronic communications or similar;
(xi) distribute viruses or any other technologies that may harm AlFursan Store or Services, Website or the interests or property of other users and Accounts;
(xii) infringe the copyright, trademark, patent, publicity, moral, database, and/or other intellectual property rights (collectively, "Intellectual Property Rights") that belong to or are licensed to us or any Intellectual Property Rights that belong to any third-parties; and
(xiii) harvest or otherwise collect information about users and other AlFursan Accounts without their consent or our consent.
10. Restrictions and Responsibilities
(a) You agree to access and use the AlFursan Store in accordance with these Terms of Use, and all applicable laws and regulations.
(b) You may not modify, distribute, sublicense, or reverse engineer the AlFursan Store.
(c) You are responsible for maintaining the security of your AlFursan Account, including safeguarding your password and all your AlFursan Account details.
(d) Unauthorized use of the AlFursan Store, including attempts to access the source code or creating derivative works, is strictly prohibited. We reserve the right to suspend or terminate access to the Services if you violate these restrictions, and you will be responsible for any associated costs or damages available to us under applicable law.
(e) You acknowledge and agree that any breach of this clause 10 shall entitle us to terminate your access or use of the AlFursan Store in its entirety without prior notice to you.
(f) Furthermore, we reserve the right to pursue any and all available remedies under applicable law in response to such breach.
(g) When using the AlFursan Store, you acknowledge and agree to abide by all applicable intellectual property laws, as well as any specific notices posted from time to time or contained on the AlFursan Store. All rights not expressly granted are reserved by us.
11. Liability and Indemnity
(a) Nothing in these Terms of Use shall limit or exclude our or your liability:
(i) for fraud, including fraudulent misrepresentation, perpetrated by that party;
(ii) for death or personal injury caused by the negligence of that party; or
(iii) for any other liability that cannot be limited or excluded under applicable law.
(b) In no event will we, our parent company, subsidiaries and affiliates, and their directors, officers, agents, employees, Suppliers, subcontractors or licensors be liable, whether based on an action or claim in contract, tort, negligence, breach of statutory duty or otherwise arising out of or in relation to these Terms of Use for loss of profits, loss of data or information, business interruption or other pecuniary loss or for any special, indirect, incidental or consequential damages, even if we, our affiliates, directors, officers, agents, employees, licensors, subcontractors or Suppliers have been advised of the possibility of such damages.
(c) In addition, to the extent permitted by applicable law, we (including our parent company, subsidiaries and affiliates and our and their directors, officers, agents, employees, Suppliers, subcontractors or licensors) are not liable, and you agree not to hold us responsible for any damages or losses resulting directly or indirectly from the content or other information you provide when accessing or using the AlFursan Store, including:
(i) pricing, shipping, format or other guidance provided by us;
(ii) delays or disruptions in our Services;
(iii) viruses or other malicious software obtained by accessing or linking to the AlFursan Store;
(iv) bugs, errors or inaccuracies of any kind;
(v) damage to your hardware device from the use of Products;
(vi) the content, actions or inactions of third-parties accessing or using the AlFursan Store; and
(vii) a suspension or other action taken by us with respect to your access or use of the AlFursan Store.
(d) You agree to indemnify and hold us, our parent company, subsidiaries and affiliates and our, and their directors, officers, agents, employees, Suppliers, subcontractors or licensors harmless from and against any losses, damages and expenses (including legal fees and attorney’s fees) (“Claims”) arising out of or relating to:
(i) any claims or demands made by any of our licensors, third-party due to or arising out of your access or use of the AlFursan Store;
(ii) your violation of any of the provisions of these Terms of Use, including, without limitation, any of the warranties, representations and undertakings;
(iii) your violation of any applicable laws, including, without limitation, data protection or anti-spam laws; or
(iv) the manner in which you access or use the AlFursan Store, including, without limitation, that the content you post (if any), the items you list or purchase or trademarks infringements of the Intellectual Property Rights of any third-party or that the content of your purchases, listings is slanderous, defamatory, obscene or violates any other rights (including privacy rights) of any third-party (including other users of the AlFursan Store).
(e) We shall not be held liable for any failure to process or honor your purchases due to circumstances beyond our control, including but not limited to natural disasters, war, terrorist acts, government regulations, or other unforeseen events. In such cases, the fulfillment of your Transactions may be temporarily suspended until normal operations can be resumed.
12. Suspension and Termination
Without affecting any of our other rights and remedies, we may suspend or terminate your access or use of the AlFursan Store if:
(a) you breach these Terms of Use or any of our published or communicated policies;
(b) we suspect on reasonable grounds that you have committed a breach of these Terms of Use;
(c) you engage in any activity that is in breach of any applicable law;
(d) you do anything that adversely affects our business or reputation;
(e) we consider that you are disrupting, disturbing or interrupting the operation of the AlFursan Store in any way;
(f) we consider that you are a fraud risk, are using multiple AlFursan Accounts, or using proxy internet protocol addresses to hide the use of multiple Accounts; or
(g) we consider it necessary, for any reason, to protect you or the other users of AlFursan Store.
13. General
(a) Governing Law: These Terms of Use and any non-contractual rights or obligations arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
(b) Dispute Resolution: If you have an issue with the AlFursan Store, please contact us via the Contact Form. We will endeavor to resolve your issue as soon as possible. Any disputes or Claims arising out of or in connection with these Terms of Use, including any non-contractual rights or obligations arising out of or in connection with these Terms of Use shall be referred to and finally resolved by the competent court in the Kingdom of Saudi Arabia.
(c) Third Party Rights: A person who is not a party to these Terms of Use has no right to enforce any of its terms.
(d) Assignment: These Terms of Use will be binding upon and ensure to the benefit of the parties and their respective successors and permitted assigns. You agree that you will not assign or transfer these Terms of Use or any of your rights or obligations under these Terms of Use, whether directly or indirectly, without first obtaining our prior written consent, such consent not to be unreasonably withheld. Additionally, you agree that we might subcontract some of our obligations to third-parties, including our Suppliers, without notifying you, in order to fulfil your Transactions.
(e) Entire Agreement: These Terms of Use and the documents referred to herein contain the entire agreement between the parties with respect to the subject matter and supersede all prior agreements, negotiations and representations, written or oral, relating to its subject matter. Except as provided in these Terms of Use and the documents referred to or incorporated into these Terms of Use by reference, there are no other conditions, representations, warranties, undertakings or agreements between the parties whether direct, indirect, collateral, express or implied.
(f) Amendment: These Terms of Use cannot be modified, varied, amended or supplemented in any way by you. We will post the current version of these Terms of Use on the AlFursan Store and each such change will be effective upon posting on AlFursan Store or upon the date designated by us as the “effective date” (if any). Your continued access and use of the AlFursan Store following any such change constitutes your agreement to be bound by and your acceptance of these Terms of Use as so modified.
(g) Severability: If any provision of these Terms of Use is determined by any court of competent jurisdiction to be invalid, illegal or unenforceable, that provision will be severed from these Terms of Use and the remaining provisions will continue in full force and effect so long as the economic or legal substance of the transactions contemplated hereby is not affected in any manner materially adverse to either of the parties.
(h) No Waiver: Any waiver by us of any of the provisions of these Terms of Use will not constitute a waiver of any other provision (whether similar or not), nor will any such waiver constitute a continuing waiver of that particular provision unless expressly provided by us in writing.
(i) Survival: All provisions that either expressly or by their nature survive will survive suspension or termination of your Account and these Terms of Use.

(c) We strive to ensure that all information provided through the AlFursan Store is accurate but do not guarantee or make any representations regarding the quality, accuracy, or completeness of any data, information, or Product. Under no circumstances will we be liable for any damages arising from your access or use of the AlFursan Store or related functionalities. We are not responsible for delays, non-availability during maintenance, or any unplanned suspensions of access due to technical reasons. You understand that any material downloaded or obtained through the AlFursan Store is done at your own risk, and you are fully responsible for any damage to your systems or loss of data.
